(A) an accident involving the resident that results in injury and may require medical intervention; (vi) take appropriate corrective action in accordance with state law if the alleged violation of residents` rights is confirmed by the institution or if a competent external body, such as the State Investigation Agency, the Quality Improvement Organization or the local law enforcement agency, confirms a violation of the rights of such residents in its jurisdiction; and (3) In the case of a resident who has not been found to have no jurisdiction by the court of the State, the resident has the right to appoint a representative in accordance with the law of the State, and any legal substitute so designated may exercise the rights of the resident to the extent provided for by the law of the State. The same-sex spouse of a resident shall receive treatment equivalent to that accorded to a spouse of different sexes if the marriage was valid in the jurisdiction in which it was concluded. (b) Exercise of rights. The resident has the right to exercise his or her rights as a resident of the facility and as a citizen or resident of the United States. C) The individual financial document is made available to the resident through quarterly accounts and upon request. (iii) the institution makes available to designated staff authorized by the resident or family group and the institution responsible for providing assistance and responding to written requests arising from group meetings; (B) This should not be construed as requiring the institution to implement every request of the resident or family group as recommended. (C) The entity shall inform the resident who requests an item or service for which a fee is charged, orally and in writing, that a fee will be charged for the item or service and what the fee will be.
